1. Information We Collect and Disclose
Jobs and Democracy PAC (“we,” “us,” or “our”) may collect your name, address, telephone number (including cell phone number), email address, and other contact information when you provide it to us. We may also obtain your name, address, telephone number, and party affiliation from publicly available voter registration files and other public databases.
Federal campaign finance laws may require the public reporting of certain contributor information, including name, mailing address, occupation, employer, and contribution amount, to the Federal Election Commission. We may share your information, including your contact information, with other political committees or organizations for political purposes.
2. Cell Phone Data
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
3. Text Messaging Program
Jobs and Democracy PAC may send political text messages regarding candidates, elections, and political issues. Message frequency varies. Standard message and data rates from your wireless carrier may apply. We are not responsible for any fees or charges your carrier may impose.
We do not guarantee the delivery of any text message. Neither we nor any wireless carrier are liable for delayed or undelivered messages. We are not responsible for any failure or delay in delivering text messages for any reason, including carrier filtering, network congestion, device incompatibility, or any other cause.
We reserve the right to modify, suspend, or discontinue the text messaging program at any time without notice.
4. Opt-Out
To opt out of text messages, reply STOP to any message from us.
5. Help
For assistance, reply HELP to any text message from us.
6. Children
Our website and communications are not directed to children under the age of 13 as defined by the Children’s Online Privacy Protection Act (15 U.S.C. § 6501 et seq.), and we do not knowingly collect personal information from children under 13.
7. Third-Party Links
Our website and text messages may contain links to third-party websites, including donation processing platforms. We are not responsible for the privacy practices, content, or security of any third-party website. Your use of any third-party website is at your own risk and subject to that website’s terms and privacy policy.
8. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
By using our website, providing your contact information to us, or receiving text messages or other communications from us, you agree to the following:
(a) Binding Arbitration.
Any dispute, claim, or controversy arising out of or relating to this Privacy Policy, our text messaging program, our website, or any communications you receive from us (“Dispute”) shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction. The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this arbitration provision. The arbitration shall be conducted by a single arbitrator in the District of Columbia.
(b) Class Action Waiver.
YOU AND JOBS AND DEMOCRACY PAC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class, consolidated, or representative proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and all Disputes shall be subject to Section 9(d).
(c) Waiver of Jury Trial.
TO THE EXTENT PERMITTED BY LAW, YOU AND JOBS AND DEMOCRACY PAC WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE.
(d) Forum and Governing Law.
This Privacy Policy and all Disputes shall be governed by the laws of the District of Columbia, without regard to conflict of laws principles. To the extent any Dispute is not subject to arbitration under this section, or if the arbitration provision is found unenforceable, you and Jobs and Democracy PAC consent to the exclusive jurisdiction and venue of the United States District Court for the District of Columbia, or if that court lacks subject matter jurisdiction, the Superior Court of the District of Columbia.
(e) Shortened Limitations Period.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THIS PRIVACY POLICY, OUR WEBSITE, OR OUR COMMUNICATIONS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CLAIM OR CAUSE OF ACTION IS PERMANENTLY BARRED.
(f) Waiver of Statutory Damages.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO STATUTORY, PUNITIVE, OR EXEMPLARY DAMAGES IN CONNECTION WITH ANY DISPUTE AND AGREE THAT ANY RECOVERY SHALL BE LIMITED TO ACTUAL, PROVEN DAMAGES.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JOBS AND DEMOCRACY PAC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR WEBSITE, OUR TEXT MESSAGING PROGRAM, OR ANY COMMUNICATIONS YOU RECEIVE FROM US, REGARDLESS OF THE THEORY OF LIABILITY.
Nothing in this Privacy Policy constitutes legal, tax, financial, or other professional advice. Any information provided through our website or communications is for informational and political purposes only.
10. Indemnification
You agree to indemnify, defend, and hold harmless Jobs and Democracy PAC, its officers, directors, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your provision of false, misleading, or inaccurate information to us; (b) your violation of any applicable law, regulation, or third-party right; or (c) your misuse of our website or communications.
11. Assumption of Risk
You acknowledge that electronic communications, including text messages, email, and internet transmissions, are inherently insecure and that no data transmission over the internet or wireless network can be guaranteed to be completely secure. You assume all risk associated with the transmission of your personal information to us and through our website.
12. Force Majeure
We shall not be liable for any failure or delay in performing any obligation under this Privacy Policy or in connection with our website or text messaging program to the extent caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, government action, carrier outages, internet disruptions, power failures, or labor disputes.
13. No Third-Party Beneficiaries
This Privacy Policy does not confer any rights, remedies, or benefits upon any person or entity other than you and Jobs and Democracy PAC. No third party may enforce any provision of this Privacy Policy.
14. Entire Agreement
This Privacy Policy constitutes the entire agreement between you and Jobs and Democracy PAC with respect to the subject matter hereof and supersedes all prior or contemporaneous oral or written communications, representations, or agreements relating to the collection, use, and disclosure of your personal information by Jobs and Democracy PAC.
15. Severability
If any provision of this Privacy Policy is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ original intent.
16. Changes to This Policy
We may update this Privacy Policy at any time. Your continued use of our website or participation in our text messaging program after any changes constitutes your acceptance of the updated Privacy Policy.
